| 内容記述 | 本稿は、スピノザの法哲学をホッブズのそれと比較することによって、スピノザの法哲学の独自性を明らかにしようとする試みである。両者の理論は、ともに「法命令説」を展開しているという点で、法実証主義の要素を持っている。しかし、仔細に検討するならば、両者には依然として自然法論者としての側面を見出すことができる。ホッブズの自然法は、古典的自然法論の考え方に忠実であり、道徳的規範としての性格を保持している。それに対して、スピノザの自然法は、規範的要素を欠いた自然法則に近いものであり、この自然法の概念が古典的自然法論の理論的枠組みを超出する可能性を秘めている。 | |||||||||||

| This paper examines the originality of Spinoza's philosophy of law in comparison with Hobbes's. Both theories contain some elements of legal positivism, deploying the so-called "command theory of law." However, a close examination reveals that both philosophers have certain characteristics as natural lawyers. While natural law in Hobbes is related to moral law, which is faithful to the traditions of classical natural law theory, Spinoza's natural law is devoid of normative elements and has a genuinely descriptive character. This concept of anormative natural law makes it possible to transcend the scheme of classical natural law theory. | ||||||||||||
