| 内容記述 | 少年法第 1条は、「少年の健全な育成を期し、非行のある少年に対して性格の矯正及び環境の調整に関する保護処分を行なうとともに、少年の刑事事件について特別の措置を講ずることを目的とする」と規定している。少年の健全育成は、少年法の目的と考えられている。こうした目的を定めている根底には、少年の可塑性の高さゆえ、犯罪を行なった少年も、適切な措置をすれば、健全な社会人として成熟する可能性が高いと考えられることから、制裁として刑罰を科すよりも、少年にとっても社会にとっても利益が大きいという考え方がある。少年の健全育成は、公的機関による正当なパターナリズムの行使と少年の人権保障との中で追求、実現されるものとして構想されている。 | |||||||||

| 値 | Article 1 of Juvenile Law prescribes that the purpose of this law is to rear juveniles soundly and to provide them with protective measures to correct their character and to adjust to their environments. The reason is that it is highly possible for even juvenile offenders to mature as sound adults if they are treated properly. Therefore, there is more interest in these protective measures not only for juveniles but also for society, rather than in imposing punishments as sanctions. We believe that the sound rearing of juveniles is realized under the exercise of due paternalism by public organizations and under the guarantee of their rights. | |||||||||
